General terms and conditions of business

1. General

These General Terms and Conditions (GTC) apply to all orders (standard and specialty items) placed by customers via the Max Chocolatier AG online shop. They form an integral part of every sale between Max Chocolatier AG and its customers. Any supplementary agreements, assurances, or amendments to these GTC must be in writing.

2. Conclusion of the contract

2.1 The purchase contract is concluded when Max Chocolatier AG sends the customer an order confirmation by email after receiving the order.
2.2 The customer places the order online. Once the order has been placed, the customer cannot make any changes to the order.


3rd Prizes

3.1 The prices listed on the website at the time of ordering apply.
3.2 Prices are quoted in Swiss francs (CHF).
3.3 Prices are subject to change without notice.


4. Shipping && Shipping time

4.1 The delivery of the ordered items is at the customer's expense. Shipping costs consist of postage and packaging costs.
4.2 Any customs duties, value added tax and similar charges incurred for international shipments are the responsibility of the recipient.
4.3 Domestic deliveries are shipped via Swiss Post. Depending on the chosen shipping method, delivery typically takes 1-3 business days. Max Chocolatier AG is not liable for external factors, delays at customs, or during transport.
4.4 Deliveries abroad are shipped via FedEx (Priority). Max Chocolatier AG is not liable for external influences, delays at customs, or during transport.
4.5 Returns made due to an error on the customer's side will be charged to the customer.

5. Delivery conditions

5.1 Max Chocolatier AG is not liable for non-delivery or delayed delivery of goods resulting from incorrect delivery address information provided by the customer and/or the recipient's absence. Return shipping costs will be charged to the customer.
5.2 For delivery delays not attributable to us, z.BMax Chocolatier AG is not liable for delays caused by the commissioned delivery service, force majeure, traffic jams, adverse weather conditions, detention by customs authorities, delays caused by third parties, etc. These circumstances do not entitle the customer to withdraw from the purchase contract or to claim damages.
5.3 The products of Max Chocolatier AG are handmade and freshly produced. Should an ordered item not be available within a reasonable timeframe, the customer will be contacted. Max Chocolatier AG reserves the right to offer an alternative.
5.4 Max Chocolatier AG reserves the right not to carry out a delivery. In this case, the customer will be contacted.

6. Alcohol-containing products

The sale of alcoholic products (wine, spirits, sparkling wine, etc.) to persons under 18 years of age is prohibited in Switzerland and Europe. By placing an order in the Max Chocolatier AG online shop, the customer acknowledges these regulations and confirms that they are legally entitled to make the purchase.

7. Payment terms

7.1 Orders in the online shop can be paid by credit card (Visa and Mastercard) or TWINT (only Switzerland).
7.2 Offsetting against counterclaims of the customer is excluded.

8. Delivery inspection/Complaints

8.1 The recipient undertakes to check the goods immediately upon receipt for completeness and condition.Any complaints regarding quality and completeness must be submitted in writing to Max Chocolatier AG within 48 hours of receiving the delivery.info@maxchocolatier.com) must be notified, otherwise the delivery will be considered accepted.
8.2 Max Chocolatier AG is not liable for transport damage.

9. Returns, Exchanges && Right of withdrawal

9.1 Returns or exchanges of products delivered to the customer in perfect condition and undamaged are excluded.
9.2 Due to the rapid perishability of the ordered Max Chocolatier AG products, the customer waives his right of withdrawal after conclusion of the contract.

10. Data protection

The data necessary for processing your order will be stored and forwarded to the company commissioned with delivery as part of the contract fulfillment process. Otherwise, stored data will not be shared with third-party companies. Max Chocolatier AG may use the data for customer relationship management purposes.

11. Applicable Law and Jurisdiction

These contracts are governed exclusively by Swiss law, excluding the Vienna Sales Convention (CISG). The exclusive place of jurisdiction is Lucerne, Switzerland.
